Terms of Service

These terms are between you and Loadcircle Ltd, a company registered in England and Wales, and they cover the Madegood app for Android. By installing or using Madegood, you agree to them.

The short version. Madegood is a tool for recording what you see on a site and handing it to somebody as a document. It is not a survey, an inspection, a certificate or legal advice, and the pack is a record of what you entered, not proof of what is true. Walking a job and reading the list back is free and stays free; building the document that goes to somebody else is the paid part, sold through Google Play.

1. What Madegood is

Madegood records a snag list. You walk a job room by room, record what needs doing, pin each item on a photograph, and mark items as settled as they are dealt with. When a job is done you can build an evidence pack: one PDF carrying the rooms, the items, the dates and the photographs with their pins.

2. What Madegood is not

It is not a survey, an inspection, a certification or an expert report, and it does not make any judgement about a building, a trade or a standard.
It does not verify anything. It records what you put into it, at the time you put it in.
It is not legal advice, and a pack is not by itself proof that a defect exists, that work was done, or that work was done properly.
It is not a dispute resolution service. What you do with a pack, and what anybody else makes of it, is between you and them.

3. The free part, and the pack

Walking a job, recording snags, attaching photographs, marking items settled and reading the list back are free, and they stay free. The pack — building the document that leaves the phone — is what is paid for. There are two ways to pay for it:

Pay once. A single payment that does not renew. The pack stays unlocked.
A year. A subscription that renews on its own until you stop it.

Both unlock the same thing: the pack, on any job you have, and every look of the app. The look you start with, Hi-Vis, is free.

4. Payment, renewal and refunds

Payment is handled entirely by Google Play, not by us. We never see your card details. That means:

The price is shown to you by Google Play in your own currency before you pay, and it is the price Google charges.
A yearly plan renews by itself at the end of each year until you cancel it. Cancelling is done in the Play Store, in your subscriptions. Cancelling stops the next renewal; it does not end the year you have already paid for.
A one-off payment does not renew. Nothing further is taken.
Refunds are handled by Google Play under Google's own policy, not ours. If you have a problem with a purchase, ask Google Play first — and if that does not settle it, write to us and we will do what we reasonably can.

5. Your licence to use Madegood

We give you a personal, non-exclusive, non-transferable licence to use Madegood on devices you control, for your own work and for the work you do for other people. You may not resell the app, rent it out, redistribute it, or attempt to extract its source code, except where the law says you may.

6. What you are responsible for

What you photograph. Photographs of a site are usually other people's property, and sometimes other people. It is your responsibility to be entitled to take them and to keep them.
What you record. The accuracy of a snag list, its dates and its marks is yours. Madegood writes down what you tell it.
Who you send a pack to. A pack contains everything in the job, including the photographs. Once you save it or send it, it is out of the app and out of our hands.
Keeping a copy. The list lives only on your phone. Nothing is synchronised and nothing is backed up by us, so uninstalling the app or losing the phone loses the list. If a job matters, hand the pack over in good time.

7. Changes and availability

We may update Madegood, add or change features, or stop supporting an old version. We do not promise that the app will always be available, or that it will work on every device. If the app cannot be started at all, or a payment fails, the app will say so rather than pretend otherwise — but we cannot promise it will always succeed, and we are not responsible for a phone that is out of storage, out of battery or otherwise unable to run it.

8. Our liability

Madegood is provided as it is. We do not warrant that it is free of errors, or that a pack will be accepted by anybody you give it to. To the extent the law allows, we are not liable for lost profits, lost work, lost opportunities, or for indirect or consequential losses arising out of your use of the app.

Nothing in these terms limits any liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are not affected by these terms, and they apply alongside them.

9. Ending these terms

You may stop using Madegood at any time, and uninstalling it ends this agreement. We may end it if you materially break these terms — for example by reselling the app. Ending it does not entitle you to a refund of a payment already made through Google Play, unless Google's own policy says otherwise.

10. Which law applies

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them. If you live elsewhere in the United Kingdom or in the European Union, you keep the protection of the mandatory consumer law of the country you live in.
